This document (as well as other documents mentioned herein) regulates the conditions governing the use of this Website and the purchase or acquisition of products on it (hereinafter Conditions). For the purposes of these Conditions, it is understood that the activity carried out through the Website includes the marketing of oil.

In addition to these Terms and Conditions, Users must read the Legal Notice, the Cookie Policy and the Privacy Policy of RAL INTELLIGENCE STRRATEGIES, S.L.U. before accessing, browsing and/or using this Website. By using this Website or by making and/or requesting the purchase of a product through it, the User agrees to be bound by these Terms and Conditions and all of the above, and should therefore refrain from using this Website whenever he or she does not agree with them.

Users are also informed that these Conditions may be amended at any time. The User is responsible for checking the Conditions every time he or she accesses, browses and/or uses the Website, since those Conditions in force at the time the products are purchased shall apply in all cases.

2.  THE USER

Anybody accessing, browsing or using this Website shall be considered a User (hereinafter User or Users), meaning they accept all the Conditions set forth herein, along with any subsequent amendments, from the moment they start browsing the Website, notwithstanding any mandatory legislation that may apply.

The User assumes full liability for using the Website correctly. This liability also extends to:

• Using this Website solely to make inquiries and legally valid purchases or acquisitions.
• Refraining from making false or fraudulent purchases. Any purchases reasonably considered to be false or fraudulent may be cancelled and the relevant authorities informed.
• Providing truthful, licit contact data, such as e-mail address, postal address and/or other data (see Legal Notice).

The User states that he or she is over 18 years of age and has the legal capacity necessary to enter into binding agreements via this Website.

Users may, at their discretion, enter into a contract of sale with RAL INTELLIGENCE STRRATEGIES, S.L.U. for the products in any of the languages these Conditions are available in on this Website.

3.  PURCHASE OR ACQUISITION PROCESS

Registered Users may make purchases on the Website through the means and forms specified. Such Users must follow RAL INTELLIGENCE STRRATEGIES, S.L.U.’s online purchase and/or acquisition procedure, selecting one or several products and adding them to the basket before finally clicking on “Buy”.

The User must fill in and/or check the information requested at each step, although these details can be amended during the purchase process, before proceeding to payment.

The User will subsequently receive an e-mail confirming that RAL INTELLIGENCE STRRATEGIES, S.L.U. has successfully received the purchase order or request. Where applicable, the User will also be sent an e-mail when the purchase ships. Where appropriate, the User may also see this information in his or her private area on the Website.

Once the purchase procedure has started, the User consents to the Website generating an electronic invoice that will be sent to the User by e-mail. Where appropriate, this may also be done via the User’s private area on the Website. The User acknowledges that, at the moment of purchase, he or she is aware of certain conditions of sale for the product in question, as shown alongside the presentation, or, where appropriate, its photo on the Website (including, but not limited to, as appropriate, the name, price, components, quantity, colour, details of the products or characteristics, how they will be carried out, and/or the cost of the services), and acknowledges that placing the purchase or acquisition order implies full, complete acceptance of the Conditions.

Unless expressly stated otherwise, RAL INTELLIGENCE STRRATEGIES, S.L.U. is not the manufacturer of any products sold or marketed on the Website. Although RAL INTELLIGENCE STRRATEGIES, S.L.U. makes great efforts to ensure that all information shown on the Website is correct, the packaging and/or materials and/or components of the products may sometimes contain additional or different information from that shown on the Website. The User should therefore not only consider the information provided on the Website, but also all information found on labels, warnings and/or instructions accompanying the product.

All communications, purchase orders and payments made during transactions on the Website may be placed on file and kept in electronic format by RAL INTELLIGENCE STRRATEGIES, S.L.U. in order to provide proof of the transactions; in such cases, RAL INTELLIGENCE STRRATEGIES, S.L.U. shall respect all reasonable conditions regarding security and applicable regulations, particularly with regards to compliance with Act 3/2018 on Personal Data Protection and guarantees of digital rights, along with all rights Users are entitled to in accordance with this Website’s privacy policy.

4.  AVAILABILITY

All purchase orders received by RAL INTELLIGENCE STRRATEGIES, S.L.U. through the Website are subject to product availability and/or circumstances of force majeure (see clause nine of these Conditions) affecting the supply of the products and/or the provision of the services. In the event of lack of stock or difficulties in the supply of products, RAL INTELLIGENCE STRRATEGIES, S.L.U. undertakes to contact the User and reimburse any amounts that may have been paid.

5.  PRICES AND PAYMENT

The prices displayed on the Website are final prices in euros (€) and include all taxes unless otherwise indicated in keeping with the law, in particular with regard to VAT.

The final product prices do not include the cost of shipping. In this regard, RAL INTELLIGENCE STRRATEGIES, S.L.U. provides delivery and/or shipping through the transport agent Correos.

The Website will not, under any circumstance, automatically add any costs other than those, freely and voluntarily chosen by the User to the price of a product.

Although the prices may change at any time, any such change will not affect any orders or purchases the User has already received an order confirmation for.

Accepted means of payment will be by credit card or bank transfer.

RAL INTELLIGENCE STRRATEGIES, S.L.U. uses all means available to it to guarantee the confidentiality and security of the User’s payment details as transmitted during transactions via the Website. These means include the Website using a secure SSL payment system.

By clicking on “Buy”, the User confirms that he or she is the owner of the payment method used, or, where applicable, is the legitimate card holder.

6.  DELIVERY

Products will only be delivered physically within Spanish territory (mainland Spain and the Balearic Islands).

The purchase order, consisting of the products listed in each purchase confirmation, will be delivered within the period indicated on the Website in accordance with the shipping method selected by the User and always within 30 calendar days from the date of the order confirmation, save for cases of unforeseen or extraordinary circumstances or, where appropriate, circumstances deriving from customisation of the products.

RAL INTELLIGENCE STRRATEGIES, S.L.U. will contact the User whenever it is, through its own fault, unable to meet the agreed delivery date, in which case the User may either continue with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Home deliveries are only made on working days.

The order may be returned to RAL INTELLIGENCE STRRATEGIES, S.L.U. whenever it cannot be delivered due to the User not being present at the place of delivery. In such cases, the transport agent would leave a note explaining where the order is located and how to have it redelivered.

The User should contact RAL INTELLIGENCE STRRATEGIES, S.L.U. to arrange delivery on another day whenever he or she cannot be at the place of delivery at the agreed time.

Whenever the order, through no fault of RAL INTELLIGENCE STRRATEGIES, S.L.U. , has not been delivered within 30 days from the date it was made available for delivery, RAL INTELLIGENCE STRRATEGIES, S.L.U. shall understand that the User wishes to withdraw from the purchase, which shall be deemed as terminated. In the event of such termination, all payments received from the User, with the exception of any additional costs resulting from the User choosing a delivery method other than the least expensive ordinary delivery method offered on the Website, will be refunded without any undue delay and always within 14 days from the date on which the purchase was deemed to be terminated.

Notwithstanding, Users should bear in mind that any additional transport costs deriving from the termination may be passed onto them.

For the purposes of these Conditions, it shall be understood that the product or order has been successfully delivered at the moment the User, or a third party indicated by the User, takes material possession of the products, as evinced by the signature indicating receipt of the order at the agreed delivery address.

The User shall assume all risks for the products following their delivery. The User shall acquire ownership of the products either when RAL INTELLIGENCE STRRATEGIES, S.L.U. receives full payment of all amounts due for the purchase or acquisition, including shipping costs, or at the time of delivery, whenever this takes place subsequent to full receipt of the amount by RAL INTELLIGENCE STRRATEGIES, S.L.U.

In accordance with the provisions of Act 37/1992, of 28th December 1992, on Value-Added Tax (VAT), all purchase orders for delivery shall be liable for Spanish VAT if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla. The VAT rate shall be as legally in force at any given time, in accordance with the specific item in question.

7.  TECHNICAL MEANS TO CORRECT ERRORS

Users are hereby informed that any error when entering the details necessary to process their purchase request on the Website can be modified or amended by contacting RAL INTELLIGENCE STRRATEGIES, S.L.U. via the contact spaces available on the Website, and, if applicable, through the means provided to contact the customer service, and/or using the contact details provided in clause one (General Information).

Users may also correct this information in their private area on the Website.

In any case, Users can access the private area and basket in order to enter their purchase requests and make any changes before clicking on “Buy”.

8.  RETURNS

Users acquiring products on or via the holder’s Website are entitled to a series of rights, as listed and described below:

Right of Withdrawal

Any User, as a consumer and user, making a purchase on the Website is entitled to cancel the purchase within 14 calendar days, without the need for justification.

This withdrawal period shall expire 14 calendar days after the date on which the User, or a third party authorised by the User (other than the transport agent) took material possession of the products purchased on RAL INTELLIGENCE STRRATEGIES, S.L.U. ‘s Website, or, if the products making up the order are delivered separately, 14 calendar days after the date on which the User, or a third party authorised by the User (other than the transport agent) took material possession of the last of the products making up the purchase order.

This right of withdrawal may only be exercised by duly informing RAL INTELLIGENCE STRRATEGIES, S.L.U. of any such decision. Where appropriate, this may also be done via the Website’s contact areas or at:

The User must clearly and unequivocally express his or her intention to withdraw from the purchased product, regardless of the means chosen to communicate this decision.

The withdrawal shall only be valid when the communication unequivocally expressing the decision to withdraw is sent before the end of the withdrawal period.

In the event of such withdrawal, RAL INTELLIGENCE STRRATEGIES, S.L.U. shall reimburse the User for all payments received, including shipping costs (with the exception of any additional costs resulting from the User choosing a delivery method other than the least expensive one offered on the Website), without any undue delay and always within 14 calendar days from the date on which RAL INTELLIGENCE STRRATEGIES, S.L.U. is informed by the User of the decision to withdraw.

RAL INTELLIGENCE STRRATEGIES, S.L.U. shall reimburse the User using the same payment method used by the User to make the initial purchase transaction. This refund will not generate any additional cost for the User. However, RAL INTELLIGENCE STRRATEGIES, S.L.U.may withhold such reimbursement until it has received the products or items in question, or until the User provides proof of their return, depending on which condition is met first.

This must be done without undue delay, and always within 14 calendar days from the date on which RAL INTELLIGENCE STRRATEGIES, S.L.U. was informed of the withdrawal decision.

The User acknowledges that he or she shall bear the direct cost of returning any products (transport, delivery). The User shall also be liable for any diminished value of the products as a result of any handling other than that strictly necessary in order to establish the nature, characteristics and operation of the products.

The User acknowledges that there are exceptions to the right of withdrawal, as set out in the Consumer and User Defence Act and other complementary laws.

In any case, no refund will be made if the product has been used beyond mere opening, is not in the same condition in which it was delivered, or has suffered any damage after delivery.

Furthermore, the products must be returned using or including all their original packaging, instructions and other accompanying documents, as well as a copy of the purchase invoice.

Return of defective products or shipping error

Whenever the User believes that the product delivered does not match that set out in the purchase order, he or she should contact RAL INTELLIGENCE STRRATEGIES, S.L.U. immediately to report the non-conformity (defect/error) via the same means, using the contact details provided in the previous section.

The User will then be asked to return the products, which, once returned, will be examined and the User informed, within a reasonable period of time, whether the product can be refunded or replaced.

The amount paid for any products returned because of a duly identified defect will be refunded in full, including all delivery charges and costs incurred by the User in making the return. The refund will be made with the same payment method as used by the User to pay for the purchase.

All rights recognised in current legislation shall apply at all times for the User, in his or her capacity of consumer and user.

Warranties

The User, as a consumer and user, enjoys warranties on the products acquired through this Website, under the terms legally established for each type of product; RAL INTELLIGENCE STRRATEGIES, S.L.U. shall therefore be liable for any lack of conformity in the products that become apparent within two years from delivery.

In this regard, it is understood that the products match the details set out in the description provided by RAL INTELLIGENCE STRRATEGIES, S.L.U., are suitable for the uses typical of such products, and have the quality and performance expected for a product of this type. Should the products delivered fail to match these expectations, the User should follow the instructions set out in the section “Return of defective products or shipping error”. Notwithstanding, some of the products marketed on the Website may present non-homogeneous characteristics due to the material used for manufacture; in such cases, these will not be considered a defect but rather part of the individual appearance of the product.

Moreover, it could be the case that the product acquired on the Website by the User is produced or manufactured by a third party. In this case, the User may contact the brand or manufacturer responsible for the product in order to report any defects and exercise his or her statutory warranty rights during the two years following delivery. In these cases, the User must have kept all information relating to the product warranty.

9.  DISCLAIMER OF LIABILITY

Unless otherwise provided by law, RAL INTELLIGENCE STRRATEGIES, S.L.U. shall be liable for the following losses, regardless of their origin:

1. Losses not attributable to any breach on its part.
2. Indirect losses not reasonably foreseeable by both parties at the time the purchase order for the products was placed.

RAL INTELLIGENCE STRRATEGIES, S.L.U. also limits its liability in the following cases:

• Although it applies appropriate measures to ensure the product is displayed correctly on the Website, RAL INTELLIGENCE STRRATEGIES, S.L.U. is not liable for any minor differences or inaccuracies caused by lack of screen resolution, browser problems, or other problems of similar nature.
• RAL INTELLIGENCE STRRATEGIES, S.L.U. shall strive to ensure the product included in the purchase order is delivered to the transport agent. However, it shall not be liable for any delays, loss or theft of the product during transit, especially for causes such as strikes, road delays, and, in general, any others typical of the haulage sector.
• Technical failures caused by unavoidable circumstances or any other reasons that prevent normal operation of the Internet, website downtime due to maintenance operations, or any other causes that make the service unavailable. Although RAL INTELLIGENCE STRRATEGIES, S.L.U.puts great effort into ensuring the purchase, payment and shipment/delivery process can be completed successfully, it shall not be liable for any causes beyond its control or cases of force majeure.

In general, RAL INTELLIGENCE STRRATEGIES, S.L.U. shall not be liable for any failure or delay in the performance of any of the obligations assumed whenever such failure or delay is due to events beyond its reasonable control, e.g. due to force majeure.

10.  WRITTEN COMMUNICATIONS AND NOTIFICATIONS

By using this Website, the User accepts that most communications with RAL INTELLIGENCE STRRATEGIES, S.L.U. will be in electronic format.

For contractual purposes, the User consents to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications sent electronically by RAL INTELLIGENCE STRRATEGIES, S.L.U.have the same legal standing as those made in writing. This condition shall not affect the User’s statutory rights.

11. FULL AND SUFFICIENT AGREEMENT

These Terms and Conditions and any document expressly referred to herein constitute the full and sufficient agreement between the User and RAL INTELLIGENCE STRRATEGIES, S.L.U. in relation to the purchase and sale, and supersede any other previous covenant, agreement or promise agreed verbally or in writing by the parties.

14.  DATA PROTECTION

We process the information provided to us so as to provide you with the service requested. The information provided will be preserved for the number of years required to comply with legal obligations.

Your data shall only be used for the aforementioned purposes and shall not be disclosed to any third parties, save for any communications to the Authorities, Agencies or Offices of the Public Administration that the data subject or his or her representative consented to in order to meet the obligations arising from the contracted services, or any others that are mandatory or authorised by law. RAL INTELLIGENCE STRRATEGIES, S.L.U. guarantees the confidentiality of the personal data contained in its files, and shall implement statutory measures to avoid, as far as possible, any alteration, loss, processing or unauthorised access. All personal data will be cancelled in our files once they are no longer necessary, duly erasing the media this information is stored on or returning it to the owner, refraining in all cases from keeping any copies.
